The Home Depot, a leading home improvement retailer, was founded in 1978 by Bernie Marcus, Arthur Blank, Pat Farrah, and Kenneth Langone. The first two stores opened in Atlanta, Georgia, with the aim of providing a one-stop shopping destination for home improvement and construction needs. The Home Depot is known for its distinctive orange and white logo, which typically features an orange roofline above the company name in bold white letters. One of Home Depot‘s most recognizable trademarks is the ‘Homesaver’ wordmark. Following its first use in 1988, the wordmark was registered in 1992. The company has grown to become one of the largest home improvement retailers globally, offering a wide range of products and services for both consumers and professionals in the construction and home improvement industries.
Home Depot is known for taking an active stance on protection of its intelletual property. In December 2010, Home Depot U.S.A., Inc. and Homer TLC, Inc. filed two trademark infringement lawsuits in California and Florida against companies using names that incorporate the terms "The" and "Depot." In the California case, Home Depot sued Nimasara Industries, Inc., operating as The Box Depot, alleging trademark infringement based on the stylized lettering and orange color scheme resembling Home Depot's trade dress. In the Florida case, Home Depot sued a company doing business as The Beer Depot, citing a similar claim of trademark infringement related to the use of blocked stenciled-style lettering and an orange color scheme. The dispute focused on the alleged intent to create consumer confusion and trade on Home Depot's goodwill.
